These General Terms and Conditions of Sale are intended to define the purchasing conditions for Siamea Services and Gift Card(s) offered by the company Siam Legacy International.
o ensure a better understanding of these GTC (General Terms and Conditions), terms beginning with a capital letter are defined as follows:
Buyer: refers to the User who has made a purchase on the Website for strictly personal use.
Seller: refers to the company that publishes the Website and has made a sale within the scope of its professional activity.
Gift Card(s): refers to a product that allows a Buyer to give a person of their choice a service or a pre-determined amount, which can be used to book one or more services on the Website.
Service(s): refers to all the wellness services offered by the Seller on the Website, such as massages or reflexology services.
Spa(s): refers to the locations where the Buyer or the beneficiary of a Siamea gift card can receive the Services they have previously purchased on the Website.
Website: refers to the interactive electronic service published and made available by the Seller, accessible at the address https://Siamea.com, from a web browser on a computer or mobile phone.
User(s): refers to any natural person accessing the Website for strictly personal use.
These GTC are applicable to Buyers and the Seller of the Website.
The purchase of Gift Card(s) or Service(s) implies the Buyer’s full and unreserved acceptance of these GTC.
The Seller reserves the right to modify these GTC. Users will be informed of any changes by any appropriate means. Modifications will not be retroactive and will apply to any purchases made after the changes have taken effect.
3.1. The Services
3.1.1. Characteristics
The Buyer can purchase/book services through the Siamea.fr Website according to the different massages offered. To do so, the Buyer may, before or after selecting the Massage for which they wish to receive the Service, access information relating to:
The name, address, location, and phone number of our salon.
The name or reference of the Services, classified by category.
The precise description of the Services and, when necessary, the list of restrictions or exclusions.
The price of the Services.
The time slots during which the Service(s) may be offered (days, hours).
3.1.2. Purchase – Booking
The Buyer can book a Service after clicking on the Book an Appointment tab (https://siamea.com/prestations). In this case, they will be asked to choose a massage, the duration, then the date and time, after selecting their desired Service. They will then be redirected to an external provider to finalize their purchase. This external provider is https://koalendar.com.
In the event that the Service cannot be provided on the date and at the time desired by the Buyer, they will be offered other available slots for the relevant Service. The booking only becomes effective once they have confirmed their availability and a date and time are set.
The Buyer will receive an email confirmation of their booking including the date and time at which the Service will be provided, the name of the beneficiary, and the essential details of their order.
The price of the Services is collected by the Seller upon payment made by the Buyer through the external provider https://koalendar.com, mentioned previously, at the time of booking confirmation.
The Services can only relate to the Services as defined in Article 1 of these GTC, which constitute a limited range of services.
3.2.1. Characteristics
The Buyer may purchase, through the Website, one or more Gift Card(s), as defined in Article 1 of these GTC.
The Seller offers two types of Gift Cards on its Website:
A Siamea Gift Card that allows one to directly gift a Service;
A Siamea Gift Card that allows one to gift a specific value, which can be used to book one or more Service(s). The values must be selected on the Website and are not customizable.
The Siamea Gift Card cannot be used for promotional offers (which are limited in time).
Siamea Gift Cards have a limited validity of one (1) year from their date of delivery.
Siamea Gift Cards cannot in any way be used with third parties.
They cannot in any way be used in exchange for products or services other than the Services offered by Siamea.
Siamea Gift Cards cannot be refunded for cash.
3.2.2. Purchase – Booking
To purchase a Siamea Gift Card, the Buyer must click on the Gift Cards tab. Two choices will be offered:
“Gift Card by amount”
“Gift Card by service”
When the Buyer wishes to give a gift card by amount, they must select one of the amounts offered on the Website.
For all Siamea gift cards by service, the Buyer will be asked to select the type of Siamea Gift Card and to provide the first and last name of the beneficiary. Then, the Buyer can decide to receive the Siamea Gift Card(s) directly, or to send it to a beneficiary of their choice by providing their email address.
The price of Siamea Gift Cards is collected by Siam Legacy International upon payment made by the Buyer through the Siamea.com Website.
Any purchase of Siamea Services or Gift Card(s) through the Siamea.com Website implies full and unreserved adherence to these GTC.
From the moment the Buyer confirms their order by clicking the “Commander” (Order) icon, they are considered to have accepted, with full knowledge and without reservation, these GTC, as well as the prices, volumes, and quantities of the Siamea Services and/or Gift Card(s) offered for sale and ordered.
The sale will only be considered final after Siamea.com sends the order confirmation to the Buyer via email to the address provided by the Buyer, and upon collection of the full payment by the company.
Siam Legacy International recommends that the Buyer keep this information on a paper document or in a digital file.
The prices for Siamea Services and Gift Card(s) are indicated in THB; the applicable rate is the one in effect at the time the Buyer validates the order. Value Added Tax (V.A.T.) is included in the prices and is applicable on the day of the order. Any change in the V.A.T. rate will be automatically reflected in the price of the Siamea Services and Gift Card(s) sold through the Site. Siam Legacy International reserves the right to modify the prices of Siamea Services and Gift Card(s) at any time and without prior notice.
Payment Methods
Siamea Services and Gift Card(s) are payable in THB, in full, at the time of the order, by: payment card (Visa, Mastercard). Payment is made through a secure online payment system, which requires the Buyer to provide their payment card number, its expiration date, and its security code (cryptogram). Any fraudulent use of the Buyer’s payment card is subject to the contractual stipulations agreed between the Buyer and the card-issuing institution.
The full amount of the order will be collected by Siam Legacy International at the time the order is validated. At no time can the sums paid be considered as deposits or down payments.
The Buyer guarantees to Siamea that they have the necessary authorizations to use the payment method chosen by them when validating their order.
Siam Legacy International reserves the right to suspend or cancel any order and/or delivery, regardless of its nature and level of execution, in the event of non-payment of any sum due by the Buyer or in the event of a payment incident.
Siam Legacy International reserves the right to request a photocopy of the Buyer’s identity card for any payment by bank card. As part of the fight against Internet fraud, information relating to your order may be transmitted to any third party for verification.
Any booking can be modified or cancelled at any time through the Website, provided that this is done no later than four (4) hours before the originally scheduled date and time.
All PROMOTIONAL bookings are non-modifiable and non-refundable.
The Buyer or beneficiary who has modified a booking through the Website will receive an email confirmation indicating the newly modified date and time.
Any delay will be deducted from the reserved Service without any possibility of compensation.
In the event of a late cancellation or a no-show for the appointment, a cancellation fee equivalent to 100% of the price paid will be retained by the Seller as compensation for the loss incurred.
Any reserved Service that has not been modified under the conditions provided for in this article will be considered as having been validly provided, even if the Buyer or beneficiary did not show up, which the Buyer expressly acknowledges and accepts.
Upon the expiration of the one (1) year period from the date the gift card is issued, it will lose all validity and can no longer be used; the price will remain the property of Siam Legacy International.
No Service will be provided for Gift Card(s) whose validity period has expired, and this period cannot be extended in any way.
The Seller cannot be held liable if the performance of one of its obligations is prevented or delayed due to a case of force majeure, as defined by Section 8 of the Civil and Commercial Code of Thailand, including, but not limited to: natural disasters, fires, war, or the malfunction or interruption of telecommunications or electrical networks.
For any purchase of Siamea Services or Gift Card(s) through the Website, the Buyer has the right to withdraw, without having to justify their decision and without penalty. This right of withdrawal must be exercised within a period of 14 (fourteen) days from:
The sending of the order confirmation to the Buyer for Services.
The delivery by email for Gift Cards.
However, this right of withdrawal cannot be exercised for services where performance has begun before the end of the withdrawal period. Regarding the Services, the Seller informs the Buyer that the performance of the service begins four (4) hours before the time booked on the Website.
The Seller will refund the Buyer within a period of 14 (fourteen) days from the date on which it is informed of the Buyer’s decision to withdraw.
For Gift Cards, the withdrawal request must be made using the form in Appendix 1 of these GTC, which can be sent by email (customercare@siamea.com).
For Services, the withdrawal request can be made directly in the order confirmation email where an Cancel button is located, and in all appointment reminder emails.
In accordance with regulations relating to the protection of personal data, the User is informed that the Seller, in its capacity as data controller, processes personal data in the context of selling Services and Gift Cards.
For further information concerning the processing of personal data and to understand their rights, the Buyer can consult the Personal Data Protection Policy, available via this link.
These GTC are subject to Thai law. In the event of a dispute relating to the application, interpretation, validity, and execution of these GTC, and in the absence of an amicable agreement between the parties, express jurisdiction is given to the courts of Thailand.
If one or more stipulations of these GTC are held to be invalid or are declared as such in application of a law, regulation, or following a final decision of a competent jurisdiction, the other stipulations shall retain their full force and effect.
The failure of either party to enforce any provision of these GTC shall not be construed as a waiver of future enforcement of that or any other provision.
